Ransin Injury Law’s Missouri Tort Law Explanation
The following our key elements of a tort lawsuit:
- Existence of a legal responsibility owed by an individual to another individual
Breach of the duty by one individual
Breach of the duty being the “proximate cause” of loss and damages suffered by an individual
Loss of damages incurred by an individual
A successful tort lawsuit will contain all of these aspects. When you have been injured in an auto accident, medical malpractice, slip and fall accident, semi-truck accident, motorcycle accident; these are all examples of torts. At Ransin Injury Law, we work with our clients to recover the full compensation their injuries are worth, and because of these types of torts, these clients have the ability to take legal action in order to recover compensation for damages, and their injuries caused by these accidents.
Missouri is an At-Fault Insurance State
In the state of Missouri, we are an at-fault state. What this means is all drivers are required by law to have automotive insurance with the following minimum limits of liability:
- $25,000 coverage per person for bodily injury
$50,000 coverage bodily injury per accident
$10,000 coverage for property damage per accident
$25,000 Uninsured motorist coverage for bodily injury per person
$50,000 Uninsured motorist coverage for bodily injury per accident
Just because Missouri requires motorists to have auto insurance, does not mean that every driver has insurance. We have handled many cases in which the at-fault driver did not have insurance. In our experience, this does not mean that if the other driver is uninsured or even underinsured you will not receive the full compensation you deserve. It just means that you have a more complex legal matter and need to hire an experienced attorney to guide you through this process.
Missouri Personal Injury Claims
At Ransin Injury Law, every tort claim, no matter if this was a negligent, intentional or strict liability has two key aspects; liability and damages. When I first sit down and meet with a client during our initial consultation, I answer these questions; was the defendant liable for the injuries you sustained, if yes, what are the full extent of your injuries both short and long term? We then use our legal system to prove liability and damages in order to receive the full compensation the clients deserve.
